Time Off & Leaves: Jury Duty and Court Appearances

Applies to: All faculty, staff and student employees

Purpose: To support college employees who are fulfilling their civil and legal obligations as jurors and witnesses

Policy

The college grants paid administrative leave to employees who are summoned for jury duty. It also pays administrative leave to those summoned to appear in court as a state witness to testify on behalf of the federal, state or local government in a criminal case. Those summoned to appear in court for any other reason may use their paid leave or leave without pay. St. Norbert complies with all applicable local and federal laws regarding paid time off.

Procedures

Jury Duty

Notification 

If you are called for jury duty, you must promptly inform your immediate supervisor and provide them with a copy of the summons.

In some jurisdictions, you may be summoned to serve jury duty on a standby or call-in basis. In this situation, you will be expected to report for work every day that you aren’t needed for jury duty. If you’re on standby and advised to report for jury duty, you must notify your supervisor using your department’s established notice-of-absence procedure.

Service 

If you’re on jury duty and the court releases you for a half-day or longer, you must notify your supervisor and be prepared to report to work. 

During extended periods of jury duty, you’re expected to stay in regular contact with your supervisor and assist in coordinating work during your absence.

Pay

While on approved jury duty, the college will pay you for administrative leave at your normal salary rate. Once the college pays you, you must turn over to the college all compensation you’ve received for your jury duty, with the exception of mileage pay.

Other Court Appearances

Notification 

If you are summoned or subpoenaed to appear in court, you must promptly inform your immediate supervisor regarding your anticipated absence from work and provide them with a copy of the summons. 

If your need to appear in court is unanticipated, you must provide an oral request for leave to your immediate supervisor prior to the start of the work shift for which the leave is requested. Or, in the case of an emergency, within 24 hours of the onset of the emergency, whichever is sooner. You must notify your supervisor using your department’s established notice-of-absence procedure.

Service

You’re expected to stay in regular contact with your supervisor during any court appearances.
